1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the CICO Walk mobile application ("App," "Service," or "we"). By using CICO Walk, you agree to comply with and be legally bound by these Terms, whether or not you create an account.

We reserve the right to update or modify these Terms at any time. We will notify you of significant changes through the App or via email. Your continued use of the App after such changes constitutes your acceptance of the new Terms.

2. Description of Service

CICO Walk is a health and fitness application designed to help users:

• Track calorie intake and expenditure
• Monitor weight loss progress
• Log food and exercise activities
• Receive personalized health insights and recommendations
• Integrate with Apple HealthKit for comprehensive health tracking

The App is intended to be a tool to assist with health and fitness goals, but it is not a substitute for professional medical advice, diagnosis, or treatment.

4. Eligibility

You must meet the following requirements to use CICO Walk:

• Be at least 13 years of age (or the minimum age required in your jurisdiction)
• Users under 18 should have parental or guardian consent
• Have the legal capacity to enter into these Terms
• Not be prohibited from using the Service under applicable laws

5. User Account and Registration

5.1 Account Creation

While CICO Walk can be used without an account, creating an account enables additional features such as cloud sync and data backup. If you create an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Keep your account credentials secure and confidential
• Notify us immediately of any unauthorized access to your account

5.2 Account Security

You are responsible for all activities that occur under your account. We are not liable for any loss or damage arising from your failure to maintain account security.

6. User Conduct and Prohibited Activities

When using CICO Walk, you agree NOT to:

• Use the App for any illegal purpose or in violation of any laws
• Violate the intellectual property rights of CICO Walk or others
• Attempt to reverse engineer, decompile, or disassemble the App
• Use automated systems (bots, scripts) to access the App
• Interfere with or disrupt the App's servers or networks
• Upload viruses, malware, or other malicious code
• Impersonate another person or entity
• Harass, threaten, or harm other users
• Collect or harvest personal information from other users
• Use the App to distribute spam or unsolicited messages
• Bypass any security features or access restrictions

7. User-Generated Content

7.1 Your Content

You retain ownership of all content you create, upload, or share through the App, including food logs, notes, and personal data. However, by using the App, you grant us a limited license to:

• Store and process your content to provide the Service
• Use aggregated, anonymized data for analytics and improvements

7.2 Content Responsibility

You are solely responsible for the accuracy and legality of your content. We do not endorse or verify user-generated content.

8. Intellectual Property Rights

CICO Walk and its entire contents, features, and functionality are owned by us and are protected by copyright, trademark, patent, trade secret, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes. You may not:

• Copy, modify, or create derivative works of the App
• Distribute, sell, lease, or sublicense the App
• Remove or alter any copyright, trademark, or proprietary notices
• Use our trademarks or branding without written permission

9. In-App Purchases and Subscriptions

9.1 Premium Features

CICO Walk may offer premium features through in-app purchases or subscriptions. By making a purchase, you agree to pay the specified fees.

9.2 Billing and Payment

• All payments are processed through the Apple App Store
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
• You can manage subscriptions and turn off auto-renewal in your Apple ID Account Settings
• Prices are subject to change with notice

9.3 Refunds

Refund policies are governed by the Apple App Store. Contact Apple directly for refund requests. We do not have control over App Store refund decisions.

10. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you consent to our data practices as described in the Privacy Policy.

11. Third-Party Services and Links

CICO Walk may integrate with or contain links to third-party services, websites, or applications (e.g., Apple HealthKit, payment processors). We are not responsible for:

• The content, accuracy, or practices of third-party services
• Any damages or losses caused by third-party services
• Privacy practices of third parties (review their terms separately)

You agree to indemnify, defend, and hold harmless CICO Walk, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including legal fees) arising from:

• Your use or misuse of the App
• Your violation of these Terms
• Your violation of any rights of another party
• Your user-generated content

14. Termination

14.1 Termination by You

You may stop using the App at any time by deleting it from your device and, if applicable, closing your account.

14.2 Termination by Us

We reserve the right to suspend or terminate your access to the App at any time, with or without notice, for:

• Violation of these Terms
• Fraudulent, abusive, or illegal activity
• Extended periods of inactivity
• Technical or security reasons

14.3 Effect of Termination

Upon termination:

• Your right to use the App immediately ceases
• We may delete your account and data (subject to legal requirements)
• Outstanding payment obligations remain due
• Certain provisions of these Terms survive termination (e.g., disclaimers, limitations of liability)

15. Geographic Restrictions

CICO Walk is intended for use in jurisdictions where such use is legal. We make no representation that the App is appropriate or available for use in all locations. If you access the App from outside the United States, you do so at your own risk and are responsible for compliance with local laws.

16. Dispute Resolution

16.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of [YOUR STATE/COUNTRY], without regard to its conflict of law provisions.

16.2 Arbitration Agreement

17. Changes to the Service

• Impose limits on certain features or restrict access
• Update the App with bug fixes and improvements

We will make reasonable efforts to notify you of significant changes.

18. Apple App Store Terms

If you downloaded CICO Walk from the Apple App Store, you acknowledge and agree that:

• These Terms are between you and us, not Apple
• Apple has no obligation to provide maintenance or support
• Apple is not responsible for addressing any claims relating to the App
• Apple is a third-party beneficiary of these Terms and may enforce them
• You must comply with Apple's Media Services Terms and Conditions

19. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.

20. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and CICO Walk regarding the use of the App and supersede any prior agreements.
